So, my old room mate is refusing to give me the second half of my deposit. I gave her thirty days notice telling her on July 14th that I was moving out on August 15th. That day I was trying to be nice and told her that she could hold on to the other half until she finds a new room mate. But money got tight for me and on the first we decided that I would use half of my deposit for rent and the other half was to be given to me on the 15th.
I talked to her today about picking up my deposit and giving her the keys and she said that because I didn’t let her know on the first she couldn’t find a room mate and that it was on me and that she won’t give my deposit back.
She then later said that she’ll give me half of what she owes me. We don’t have a signed agreement and I always paid my rent to her. Should I just take what she is willing to give me or do I have a case to take to the landlord (whom I never met), or small claims court to get all of my money?
